Explain the concept of void agreements under the Indian Contract Act, 1872.

According to Section 2(g) of Indian Contract Act, an agreement not enforceable by law is said to be void. The agreements which are declared by the Contract Act to be void are,

  1. An agreement whose consideration or object is unlawful – Section 23

A Consideration is unlawful if -

  • it is forbidden by law
  • it would defeat the provisions of any law
  • it is fraudulent
  • it causes injury to the person or property of another
  • the Court regards it as immoral
  • the Court regards it as opposed to Public Policy
  1. Agreements whose considerations and objects unlawful in part – Section 24
  2. Agreements made without consideration but for the 3 exceptions – Section 25
  3. An Agreement in restraint of a marriage of any person other than a minor – Section 26
  4. An Agreement in restraint of trade, lawful profession or business of any kind – Section 27
  5. An Agreement in restraint of legal proceedings – Section 28
  6. Agreements with uncertain meaning – Section 29
  7. Agreements by way of wager or any game or other uncertain event – Section 30
  8. An Agreement to enter into an agreement in future
  9. An Agreement to do an act impossible in itself – Section 56

Void Agreements except that mentioned in Section 56 are enlisted in Chapter 2 of the Indian Contract Act.
